0. Definitions

**Typeface** refers to the font software and the complete set of characters and glyphs, including all representations, graphics, styles, weights, and derived images (png, jpeg, bitmap, etc.), rasterized vectors, and code.

**Digital Font** means the font software, including typeface designs, outlines, glyphs, letters, digital metrics, and accompanying documentation.

**Licensee** refers to the Buyer of the font software.

**Supplier** refers to LB Type, a division of Laura Bennett Design, located in Los Angeles, California.


1. Acceptance of Terms

By purchasing, downloading, installing, or using the Digital Font, you confirm that you have read, understood, and agreed to the terms of this End User License Agreement (EULA). If you do not accept these terms, do not purchase, access, download, install, or use the Digital Font.

 

2. Copyright & Intellectual Property

Our font software is owned by LB Type, a division of Laura Bennett Design, and is protected by United States copyright law and international treaties. The intellectual property rights to the design contained in the font software, including but not limited to the typeface design, code, and all accompanying documentation, are exclusively owned by LB Type.

When you purchase a font license, you acquire a non-exclusive, non-refundable license which grants you certain rights to use the font software as specified in this agreement. This is not an agreement for the sale of the font software, its design, or any portion thereof. Except for your right to use the font software granted by this license, all other rights are owned and retained by LB Type.

Under no circumstances may you convert, modify, reverse engineer, decompile, or disassemble the original font software. You may not manipulate the font in any way that would reveal its structure, organization, or code, nor may you open the original font software in an editing software for this purpose.

You may not use the original font software to create derivative or modified products or designs, including creating characters for alphabets and languages not covered by the typeface or designing a custom version of the typeface. Even if converted to outlines with the help of an editing or design software, you may not modify the design of the characters contained in the font software.

In the event that permission is given to you for a modification or custom version of the typeface, any and all modifications and additions shall become and shall remain the sole and exclusive property of LB Type. You are also prohibited from promoting violence or discrimination (of any kind) through the use of the fonts, creating derivative works based on the fonts, placing the fonts on public servers, and/or adding the fonts to public repositories.

 

3. License Types & Usage

3.1 DESKTOP LICENSE

The Desktop License is determined solely by the total number of employees within the Licensee’s organization or client’s organization, including full-time, part-time, and contract employees. LB Type offers five standard license tiers based on organization size: Small (1-5 employees), Medium (6-25 employees), Large (26-50 employees), Extra Large (51-100 employees), and Enterprise (101-250 employees). Organizations with over 250 employees must contact LB Type directly for a custom enterprise quote.

A Desktop License grants the Licensee perpetual rights to install and use the Digital Font on computers within their licensed organization. This license permits the creation of static images for both personal and commercial use and is applicable for print and digital design projects. The Desktop License explicitly does not allow embedding or distribution of the Font Software outside the licensed organization.

 

3.2 WEB LICENSE

Web Licenses enable the embedding of fonts on websites through a tiered structure based on monthly page views. The tiers are structured as follows: Tier 1 supports up to 10,000 monthly page views, Tier 2 covers 10,001 to 50,000 views, Tier 3 extends to 50,001 to 250,000 views, and Tier 4 accommodates 250,001 to 1,000,000 views. Custom solutions are available for sites exceeding these thresholds.

All Web Licenses are restricted to specified domains and must utilize the provided web font files. Direct distribution of font files is strictly prohibited, and the license requires implementation of appropriate technical measures to prevent unauthorized access or downloading of the font files.


3.3 APP LICENSE

The App License permits font embedding in mobile and desktop applications across iOS, Android, and Windows platforms. Licensees may choose from several duration options: 1-Year License, 3-Year License, 5-Year License, or Perpetual License. This license specifically restricts font extraction and direct distribution, ensuring the integrity of the font software within the application environment.


3.4 CUSTOM LICENSING

Certain uses of LB Type fonts require custom licensing arrangements. This includes publication usage, logo and branding applications, broadcasting and media implementations, social media campaigns, digital advertising, and enterprise deployments for organizations exceeding 250 employees. Any usage scenarios not explicitly covered by our Desktop, Web, or App licenses also require custom licensing. 4. Restrictions & Usage Guidelines

4.1 GENERAL USAGE RESTRICTIONS

The Digital Font must not be installed or used on any server that can be accessed via the Internet or other external network systems without appropriate licensing and security measures in place. When sharing documents with third parties, all content must be either vectorized or embedded inside an image format (PNG, JPG, TIFF) or within a secured PDF format. Any installation of the Digital Font on servers must ensure that remote users cannot access or download the font files directly.

 

4.2 TECHNICAL AND MODIFICATIONS RESTRICTIONS

The Licensee is expressly prohibited from modifying, altering, adapting, translating, reverse engineering, decompiling, or disassembling the Digital Font in any way. The creation of derivative works based on the Typeface is not permitted, nor is the sub-licensing, selling, leasing, or distribution of the Digital Font to any third party. The font software must not be embedded in any manner that would allow extraction or unauthorized use by others.


4.3 CONTENT RESTRICTIONS

The use of the Typeface for illegal, discriminatory, or offensive content is strictly prohibited. Usage in political or religious contexts requires explicit written permission from LB Type. We reserve the right to revoke licenses if the Digital Font is used in ways that could harm LB Type’s reputation or brand value.

  • Modify, alter, adapt, translate, reverse engineer, decompile, or disassemble the Digital Font
  • Create derivative works based on the Typeface         
  • Sub-license, sell, lease, or distribute the Digital Font
  • Embed fonts in a manner that allows extraction or unauthorized use
  • Use the Typeface for illegal, discriminatory, or offensive content

 

5. Embedding & Distribution

5.1 Embedding is permitted only in read-only formats that prevent font extraction.

5.2 Documents sent to third parties must have text converted to outlines or embedded in secure formats (PDF, image).

 

6. Multiple User Scenarios

6.1 DESIGNERS AND AGENCIES

Design professionals and agencies working with clients must ensure appropriate licensing for all font usage. When purchasing on behalf of clients, the agency must establish the client as the license owner, as they will be the end user of the font software. Agencies are required to transfer ownership of the font license to their clients and remove all copies from their systems once the project is completed. The pricing charged to clients for font licenses must align with LB Type’s published rates, and clients must accept this EULA before any font installation or use begins. It’s important to note that temporary employees and contractors are not covered under an agency’s existing license.


6.2 ENTERPRISE AND MULTI-LOCATION USAGE

Organizations operating across multiple locations or with complex deployment needs require specific enterprise licensing arrangements. These licenses are customized based on the total employee count and specific usage requirements of the organization. Enterprise clients should contact LB Type directly to discuss their needs and obtain appropriate licensing terms.


6.3 CLIENT LICENSE TRANSFER PROCESS

The transfer of font licenses to clients must be handled with careful attention to proper procedures. The client, as the ultimate end user, must be established as the license owner from the outset. Agencies facilitating these transfers must ensure their clients formally accept this EULA before receiving any font files. Upon completing the transfer process, agencies are required to thoroughly remove all copies of the font software from their systems, including any backup copies or cached files.

 

7. License Maintenance & Updates

Licensees are responsible for maintaining accurate licensing status and must notify LB Type of any changes in their organization’s employee count that might affect their license tier. We require annual verification of license compliance to ensure proper usage of our font software. LB Type reserves the right to perform periodic checks using publicly available information to verify compliance. When an organization’s size increases beyond their current license tier, an upgrade to the appropriate tier is required to maintain license validity.

 

8. Credits & Attribution

8.1 USER USAGE CREDIT

Licensees are encouraged to credit LB Type in project colophons:`Digital Font Name, ©LB Type`

 

8.2 PORTFOLIO AND SHOWCASE RIGHTS

As part of our commitment to celebrating great typography and design, LB Type reserves the right to showcase and share how our fonts are used in the wild. This includes featuring work on our social media channels, website, printed materials, books, magazines, and during lectures or presentations. We will only share projects and images that are already publicly accessible, and we are committed to properly crediting project authors whenever possible. If you would like to share your project with us, please email info@lbtype.com. Should you have a justified reason for requesting an exception to this showcase clause, please submit your request in writing to the same address.

 

9. Refund Policy 

LB Type maintains a strict no-refund policy for all software licenses. All sales are considered final upon purchase. If you encounter technical issues with our fonts, please contact our support team at info@lbtype.com, and we will work diligently to resolve any problems. By completing your purchase, you acknowledge and agree to these terms.

 

10. Trial & Student Licenses

LB Type may offer trial licenses for evaluation and testing purposes. To request a trial license, please contact info@lbtype.com with detailed information about your intended use. For student licenses, we require valid proof of current enrollment at an accredited educational institution. Student licenses are restricted to academic and personal projects only, and any commercial use after graduation requires the purchase of an appropriate commercial license.


11. Compatibility & Technical Specifications

LB Type delivers Desktop fonts in OpenType (.otf) format and Web fonts in WOFF and WOFF2 formats. Additional formats may be available upon request. Our fonts are thoroughly tested for compatibility with major operating systems including macOS and Windows, and work seamlessly with standard design applications. The support of OpenType features may vary depending on the application and platform being used.

We provide comprehensive technical support for the first 30 days following your purchase. During this period, our team is available to assist with any installation issues or technical concerns. 12. Warranty & Liability

12.1 LIMITED WARRANTY

The Digital Font is provided “as is” without any warranty of any kind, either expressed or implied. LB Type makes no guarantees that the font will meet your specific requirements or expectations. Any implied warranties are valid only for the first 30 days following your purchase. After this period, no warranties of any kind shall apply to the Digital Font or its use.


12.2 LIMITATION OF LIABILITY

LB Type’s total liability in any circumstance is strictly limited to the license fee paid. We specifically disclaim liability for any indirect damages, including but not limited to loss of profits or earnings, business interruption, loss of business information, or any third-party claims. These limitations of liability remain in effect even in cases where LB Type has been advised of the possibility of such damages occurring.


12.3 INDEMNIFICATION

The Licensee agrees to indemnify and hold LB Type harmless against any claims, damages, or losses arising from violations of this license agreement, including reasonable legal fees and expenses incurred in defending against such claims.

 

13. Termination

13.1 AUTOMATIC TERMINATION

This EULA terminates automatically and immediately upon any breach of its terms. Upon such termination, all use of the Digital Font must cease immediately, and the Licensee loses all rights granted under this agreement.


13.2 TERMINATION PROCEDURES

Following termination, the Licensee must destroy all copies of the Digital Font within seven (7) days. This requirement encompasses all copies on any devices, servers, backups, or other storage media. LB Type reserves the right to require written confirmation that such deletion has occurred. Any sub-licenses or permissions granted under this agreement become void upon termination.


13.3 POST-TERMINATION RIGHTS

LB Type maintains the right to pursue any and all legal remedies following termination, including but not limited to monetary damages, injunctive relief, and recovery of legal fees. The termination of this agreement does not waive or limit any other legal rights or remedies available to LB Type under applicable law.

 

14. Governing Law and Jurisdiction

This End User License Agreement (EULA) is governed by and shall be construed in accordance with the laws of the State of California, United States of America, without regard to its conflicts of law principles. You expressly agree that the United States District Court for the Central District of California and the Superior Court of Los Angeles County, California shall have exclusive jurisdiction over any claim or dispute arising out of or relating to this EULA or your use of the Digital Font.

Both parties consent to the exclusive jurisdiction of these courts and waive any objection to such jurisdiction or venue. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this agreement.

You are responsible for complying with all applicable local, state, federal, and international laws regarding the import, use, and export of the Digital Font. This includes, but is not limited to, laws and regulations pertaining to intellectual property rights, content restrictions, and export controls. You are also responsible for any taxes incurred in your jurisdiction, including sales tax, value-added tax (VAT), or withholding taxes, and these will not be deducted from your payments to LB Type.

Any delay or failure in exercising any rights under this agreement, or any waiver of a breach of this agreement, shall not constitute a waiver of any other rights or any subsequent breach. This agreement constitutes the entire agreement between the parties concerning its subject matter and supersedes all prior and contemporaneous agreements, proposals, or representations, written or oral. No modification of this agreement shall be binding unless executed in writing by both parties.

In the event of any dispute arising from this agreement, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs. Any legal action arising out of or relating to this agreement must be commenced within one year after the cause of action accrues.
